As of late 2025, seven U.S. states have enacted comprehensive Extended Producer Responsibility (EPR) laws for packaging, aimed at reducing waste and shifting management costs to producers: California, Colorado, Maine, Maryland, Minnesota, Oregon, and Washington.

After multiple attempts to enact legilation, it has continued to fail, see information on the legislative session.

While the bill formally passed in the Senate in 2024, time ran out before the Assembly could bring it to a vote.
